The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.

{Based on information obtained under the Right to Information Act, 2oo5}

The objectives of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 [referred to as the ‘Act’ in this write up] very clearly emphasize the intention of the Indian State to deliver justice to the scheduled caste and scheduled tribe communities through affirmative action in order to enable them to live in society with dignity and self-esteem and without fear, violence or suppression from the dominant castes.

The Supreme Court of India too reiterated the significance and importance of the Act in 1995 and at periodic intervals. On 25 October 2021, the Supreme Court bench consisting of Chief Justice N.V. Ramana, Justice J Surya Kant and Justice Hima Kohli held that:

The SC/ST Act has been specifically enacted to deter acts of indignity, humiliation and harassment against members of Scheduled Castes and Scheduled Tribes. The Act is also recognition of the depressing reality that despite undertaking several measures, the Scheduled Castes/Scheduled Tribes continue to be subjected to various atrocities at the hands of upper castes. The Courts have to be mindful of the fact that the Act has been enacted keeping in view the express constitutional safeguards enumerated in Articles 15, 17 and 21 of the Constitution, with a twin fold objective of protecting the members of these vulnerable communities as well as to provide relief and rehabilitation to the victims of caste based atrocities”.

AN INSIGHT INTO IMPLEMENTATION OF PoA IN HIMACHAL

  1. MONITORING MECHANISM

Section 21 of the PoA requires State Government to put in place structure for effective implementation of the Act.

Illustrative study of such duties is as follows:

  1. Monthly review at District level and submission of reports thereof.

Sub Rule 4 (4) of the PoA Rules provides that

the District Magistrate and the Office-in-charge of the prosecution at District level, shall review;

  1. the position of cases registered under the Act;

  2. the implementation of the rights of victim and witnesses, specified under the provisions of Chapter IVA of the Act,

and submit a monthly report on or before 20th day of each subsequent month to the Director Prosecution and the State Government, which shall specify the actions taken or proposed to be taken in respect of investigation and prosecution of each case.”

Copies of reports submitted for the months of February, March and April, 2024 under this provision were sought under the RTI Act. Such reports only have details of pending cases during each month. There is nothing to indicate that the reports were as a sequel to review meeting unser this provision. Which connotes that position of cases registered are not being reviewed. Similarly nothing is being done to implement the rights elaborated under Section 15A of the Act.

  • In case FIR No. 26/23 dated 14.3.2023, u/s 302, 325, 341, 34 IPC; 3(2) (v) PoA , PS Kot Kehloor, S/V Pradeep Kumar etc, the accused were discharged from charges u/s 3 of PoA vide order 19.1.2024. The proposal for filing revision against the order is submitted to the Government through DM Bilaspur vide letter No. 49 dated 8.4.2024 from DA.

  1. Time frame set for investigation and trials

Rule 7(2): The investigating officer shall complete the investigation on top priority and file the charge sheet within sixty days from the date of registration of FIR.

Rule 7 (2A): Any delay must be explained in writing by the investigating officer.

When computed from the District wise tables of pendecy drawn heretofore, there are a large number of cases in which this time line was flouted unexplained and with impunity.

Section 14 (3): In every trial in the Special Court or the Exclusive Special Court, the proceedings shall be continued from day-to-day until all the witnesses in attendance have been examined, unless the Special Court or the Exclusive Special Court finds the adjournment of the same beyond the following day to be necessary for reasons to be recorded in writing.

Provided that when the trial relates to an offence under this Act, the trial shall, as far as possible, be completed within a period of two months from the date of filing the charge sheet.


Some cases have taken more than ten years. Time frame for conclusion ot trials as mandated by the Act appears impossible situation under the present circumstances.





























  1. District Level Vigilance and Monitoring Committee

Rule 17 (1) of PoA Rules lays down as follows:

In each District within the State, the District Magistrate shall set up a vigilance and monitoring committee in his district to review the implementation of the provisions of the Act, relief and rehabilitation facilities provided to the victims and other matters connected therewith, prosecution of cased under the Act, role of different officers/agencies responsible for implementing the provisions of the Act and various reports received by District Administration.

Rule 17 (2) details constitution of the committee.

Copies of proceedings of (last) meetings of District Level Vigilance and Monitoring Committees were obtained under the RTI Act. Following is the gist of information received:

c) Relief and Rehabilitation: Victims at sr. no. 1 & 3 were sanctioned first installments of 25000/- vide DM order dated 22.7.2024- after lapse of more than two years in the first case and more than nine months in the second. Nothing is known about the third case. Cases at sr. no. 2 & 3 are being tried for crime under 376 IPC (POCSO). Economic rehabilitation of these victims was not even discussed.

Case FIR 346/23 dated 18.9.2023 was registered in P S Mullana, Ambala, under 306 IPC and Section 3 of PoA. In this case victim was Arju Negi from Yangpa-II, Kinnaur. She suggested that Trusts may be constituted for such temples. The District Magistrate decided that this proposal shall be submitted to the government. No such proposal was however sent.

Case FIR No. 27/22 P S Bharari was quashed by Hon H C. Case FIR 26/23, P S Kot Kahloor and FIR 72/22, P S Jhandutta have been sent to Government through DM for Revision.

b) Review of cases under investigation was not done.

Relief and Rehabilitation:

Monetary relief was taken care of. Other connected issues like rehabilitation of the victims were not discussed notwithstanding the fact that of the 40 cases pending (as in April, 2024) before the Special Court, two cases were under Section 376 of IPC, inter alia.

Sh Praksh Bansal, non official member pointed out that at present relief is provided in relation to only one Section (out of multiple Sections) made out in the case. He suggested that different amounts be sanctioned for case made out under different Sections-issue put for legal opinion/consideration by the Committee.



11. Sirmour

Attendance- Meeting was held on 25.6.2024. It was attended by Addl SP, DA, 4 other officials and five non official members. None of the public representatives was present.

Issues discussed:

a) Review of cases pending in the Special Court.

Total cases registered from 2021 to May 2024 were 59. 33 cases were pending trial before Special Court. There was conviction in two cases and acquittal in two. Ten cases were quashed; Sections of PoA were removed in eight cases. Case wise details are not mentioned. Issues like bails, interim/final orders and revision/appeals thereof have not been touched.

b) Review of cases under investigation-

Four cases were under investigation. Details are smartly avoided. Cancellation Report of the case FIR 34/24, P S Nahan Sadar, was submitted to the Committee which was vetted.

Relief and Rehabilitation:

76.20 lackhs were disbursed in 55 cases (56+10= 66 victims). Other connected issues like rehabilitation of the victims were not touched notwithstanding the fact that of the 41 cases pending (as in April, 2024) before the Special Court, ten cases were under Section 376 of IPC, inter alia.

SLPs in Kedar Singh Zindan (Sirmour) Murder Case

Smt Hemlata, widow of the victim had to file SLP before Honorable Supreme Court against order and judgment dated 23.4.2024 of Honorable High Court of HP in CRA No 26/2022. After much dilly dallying the State of HP also filed belated SLPs.

Attendance- Meeting was held on 19.3.2024. It was attended by S P, other officials and five non official members. None of the public representatives was present.

D. Nomination of Nodal Officer

Rule 9 provides that “the State Government shall nominate a nodal officer of the level of a Secretary to the Government preferably belonging to the Scheduled Caste or the Scheduled Tribe, for coordinating the functioning of the District Magistrates and Superintendants of Police or other officers authorized by them, investigating officers and other officers responsible for implementing the provisions fof the Act. By the end of every quarter, the nodal officer shall review:-

  1. the reports received by the State Government under sub-rules (2) and 4 of rule 4, Cl. (xi) of rule 8;

  2. the position of cases registered under the Act;

  3. law and order situation in the identified area;

  4. various kinds of measures adopted for providing immediate relief in cash or kind or both to the victims of atrocity or his or her dependent;

  5. adequacy of immediate facilities like rationing, clothing, shelter, legal aid, travelling allowance, daily allowance and transport facilities provided to the victims of atrocity or his or her dependents;

  6. performance of non-Governmental organizations, the Scheduled Castes and the Scheduled Tribes Protection Cell, various committees and the public servants responsible for implementing the provisions of the Act;

  7. implementation of the rights of the victims and witnesses specified under the prvisions of Chapter IV A of the Act.”



Information on this issue was released during ides of July 2024. As on ides of July 2024 last review meeting was held on 9.6.2020 under the chairmanship of ACS (SJ&E). Gist of the items scanned through is as follows:

  1. Position of cases registered: There was no data base-direction was made to update the data.

  2. Law and order situation in the identified areas: No area prone to atrocity was identified in the State.

  3. Sensitization workshops: It was felt that there is need for organizing sensitization workshops for functionaries of various stakeholders at State/Division/District levels. Workshops were planned for next November-January.

  4. Status of cases pending trial: Concerns were shown for large number of cases pending trial and for low conviction rates. There was no complete list of cases pending trial and Prosecution Department was asked to supply it. Notwithstanding it was mentioned that more than 300 cases were pending of 2016, 2017 & 2018 itself and 85 of 2019. It was held that issue needs to be taken up with Registrar, High Court for speedy disposal.

  5. Status of implementation of PoA: It was decided that review meeting shall be held through video conferencing with Districts shortly.

There is tremendous gap between what is mandated by Rule 9 and what was actually reviewed.

Follow up action taken on the decisions taken on review meeting of 9.6.2020.

Item: 1 & 3: ADG (CID) filed following information:

  1. Status of registered cases upto December 2019 has been updated.

  2. State level SC/ST Protection Cell has been constituted under the charge of DGP. It reviews the position of cases registered under the Act.

  3. Police personnel dealing with the cases of atrocities are being trained and sensitized. After 2015 amendment of PoA four training programs were conducted and 68 Police Officers sensitized.



  • DWO Kangra informed that 12 training/sensitization camps were held during 2019 at Gram Panchayats level.

  • DWO Kinnaur informed that he has supplied information to the Directorate on 1.7.2020. But it was not supplied under the RTI Act.

  • No information from other DWOs or other Officers.

Item 4: Director Prosecution filed list of 397 cases pending trial as in ides of July 2020.

  • There is nothing to suggest that

  • review with Districts via VC took place;

  • matter was taken up with Registrar, High Court;

  • workshops planned for Nov-January took place during that period or thereafter;



and the like.



Vide notification number SJE-B-A(4)-18/2018 dated 22.4.2021, Director, ESOMSA was nominated as nodal officer. Till ides of July 2024, compliance of Rule 9 was yet to take off under the new regime.





  1. State level Vigilance and Monitoring Committee.



Rule 16(1) mandates that the State Government shall constitute high power vigilance and monitoring committee consisting of the following:

  1. Chief Minister-Chairman;

  2. Home Minister, Finance Minister and Minister in charge of welfare and development of the SC/ST- members;

  3. All elected MP/MLAs belonging to SC/ST shall be members;

  4. Chief Secretary, the Home Secretary, the DGP, Director/Deputy Director of NCSC/NCST shall be members;

  5. The Secretary in charge of welfare and development of the SC/ST shall be convener.



Rule 16(2) lays down that the high power vigilance and monitoring committee shall meet at least twice in a calendar year, in the month of January and July to review the implementation of the Act, scheme for the rights and entitlements of victims and witnesses in accessing justice, as specified in sub section (11) of Section 15A of Chapter IVA of the Act, relief and rehabilitation facilities provided to the victims and other matters connected therewith, prosecution of cases under the Act, role of different officers or agencies responsible for implementing the provisions of the Act and review of various reports received by the State Government including that of nodal officer and special officer.

State level Vigilance and Monitoring Committee (SLV&MC) has been constituted and reconstituted from time to time. As in May 2024, last meeting of SLV&MC was held on 16.10.2014.

Issues deliberated:

  1. Review of meeting held on 26.4.2013:

  1. There were 130 cases pending trial in different Special Courts in the State.

  2. In compliance of direction issued in the meeting instructions were issued vide No SC/ST (CID)2013-5732-44 dated 26.7.2013 to complete investigation within 30 days.

  3. Government of India has issued directions to constitute exclusive special courts for speedy disposal of cases. The Chief Secretary and Department of Prosecution replied that number of cases was very small as compared to other States and therefore there is n need to open exclusive special courts exclusive special courts and that the matter will be reviewed depending upon the circumstances.

  4. District Attorneys stand issued directions vide letter No. DDPVad-2013/5408-18 dated 27.7.20213 to take steps to improve rate of conviction.

  5. DMs were instructed to review pending cases.

  6. No applications were received for legal aid.



New Items:

  1. 29 cases were pending investigation as on 1.1.2013, 108 cases were registered in calendar year 2013 and 67 cases were registered from 1.1.2014 to 31.8.2014. Out of 204 FIRs 59 were cancelled, one was untraced, 33 were pending investigation and 111 were put in Court. Sections of PoA were removed by Courts in 27 cases and five cases were decided. Cumulative cases pending trial were 137. Appeals were pending in High Court in 8 cases.

  2. Directions were issued to curtail the prevalence of atrocities, to eliminate lapses in registration of cases, to preempt onerous outside court settlements, to complete investigations within 30 days and to work for enhancement of convictions.

  3. Matter regarding speedy disposal of long pending cases before Special Courts may be taken up with Registrar General.

  4. No application for legal aid was received in calendar year 2012.

  5. Payment of relief figures was presented. Issue of payment of TA, DA , maintenance allowances and transport facilities to the victims of atrocity, dependent and witnesses was not touched.



  • Issues like bails, interim/final orders and revision/appeals thereof have not been touched.

  • Other connected issues like rehabilitation of the victims were not touched notwithstanding the fact that of the data presented before the Committee shows that 52 cases were under Section 376 of IPC, inter alia and one under Section 302 of IPC among others.

  • Matter regarding implementation of rights of victims specified under the provisions of Chapter IVA of the Act got scant attention.

  • There was no concrete discussion on the preventive measures, functioning of protection cell, spot visits/ inspections by various officers.

And the like.

  1. Scheduled Castes and Scheduled Tribes Protection Cell

Rule 8 provides as follows:

(1) The State government shall set up a Scheduled Castes and Scheduled Tribes Protection Cell at the State headquarters under the charge of Director General of Police/Inspector General of Police. This Cell be responsible for-

  1. conducting survey of the identified area;

  2. maintaining public order and tranquility in the identified area;

  3. recommending to the State Government for deployment of special police force or establishment of special police post in the identified area;

  4. making investigation about the probable causes leading to an offence under the Act;

  5. restoring the feeling of security amongst the members of Scheduled Castes and Scheduled Tribes;

  6. informing the nodal officer and special officer about the law and order situation in the identified area;

(via) informing the nodal officer and the concerned District Magistrates about implementation of the rights of victims and witnesses specified under the provisions of Chapter IVA of the Act;

  1. making enquiries about the investigation and spot inspections conducted by various officers;

  2. making enquiries about the action taken by Superintendent of Police in the cases where an officer-in-charge of the police station has refused to enter an information in a book to be maintained by that police station under sub-rule (3) or rule 5;

(ix) making enquiries about willful negligence by a public servant;

  1. reviewing the position of cases registered under the Act, and

(xi) submitting a monthly report on or before 20th day of each subsequent month to the State Government, nodal officer about the action taken/proposed to be taken, in respect of the above.


Vide Notification No, Kalyan-F(4)-14/76-VI dated 18.2.1997 the Government in the Department of Social Justice and Empowerment constituted the Scheduled Castes and Scheduled Tribes Protection Cell at State headquarters under the charge of DGP to carry out above specified functions and “to submit a monthly report on or before 20th day of each subsequent month to the Secretary (Home) and to the Nodal Officer i.e. Commissioner-cum-Secretary (Welfare) about the action taken/proposed to be taken, in respect of the above.”


Copies of last three monthly reports submitted by the said Protection Cell to Secretary (Home) and to the Nodal Officer were sought under the Right to Information Act, The PIO provided copies of statements of cased registered under the PoA, cases under investigation, cases pending trial and the like. In the appeal the first appellate authority-cum-DIG (Crime) CID also observed that “whatever information was available in the record has been shared with the applicant. Apart from this, the query raised by the appellant regarding the information is not available in the office record.” Therefore, the appellate authority upheld the decision of PIO.

There is no nexus between the information provided and the functions delineated under Rule 8.

Inescapable and natural corollary is that the Protection Cell has not been practically established,

  1. Review of position of investigations done


As per Rule 7(3) the Home Secretary and the Social Welfare Secretary to the Government, Director of Prosecution/officer-in-charge of Prosecution and the Director General of Police shall review by the end of every quarter the position of investigations done by the investigating officers.


Information in relation to last review meeting conducted under this provision was sought both from Home and Social Justice and Empowerment Departments. It is nil. This mandate is also not being complied with,




II Contingency Plan

Rue 15 lays down as follows:

15 (1). The State Government shall frame an independent plan to effectively implement the provisions of the Act and notify the same in the official gazette of the State Government. It should specify the role and responsibility of various departments and their officers at different levels, role and responsibility of rural/urban local bodies and non-Government organizations. Inter-alia this plan shall contain a package of relief measures including the following:

  1. scheme to provide immediate relief an cash or in kind or both;

(aa) an appropriate scheme for the rights and entitlements of victims and witnesses in accessing justice, as specified in sub-section (11) of Section 15A of Chapter IVA f the Act;

  1. allotment of agricultural land and house sites;

  2. the rehabilitation packages;

  3. scheme for employment in Government or Government Undertakings to the dependent or one of the family members of the victim;

  4. pension scheme for widows, dependent children, handicapped or old age victims of atrocity;

  5. mandatory compensation for the victims;

  6. scheme for strengthening the socioeconomic condition of the victims;

  7. provisions for providing brick/stone masonry house to the victims;

  8. such other such elements as health care, supply of essential commodities, electrification, adequate drinking water facility, burial/cremation ground and link roads to the scheduled castes and the scheduled tribes.”



The State Government in the Department of Social Justice & Empowerment, notified model contingency plan vide No. SJE-B-A(5)-4/2012 dated 3.10.2012 which lays down roles and responsibilities of State/District level officers and PRIs/ULBs and provides for packages of relief and rehabilitation measures.



As regards the packages of relief and rehabilitation measures following are the total provisions as delineated in the contingency plan:

(i)The victim shall be provided monetary relief as per the norms laid down in rule 12 (4).

(ii) In case of complete destruction/burnt of his own house, single room humet is to be provided gy District Administration at Govt. Cost. In case of destruction/burnt of rented house, 4 Biswa Land is to be provided by the District Administration and a single room hutmet is to be provided by District Admin. At Govt. cost. Electricity/water connection shall be prvided by H.P.State Electricity Board/Irrigation and Public Health Deptt on priority basis.



(iii) In case of death of earning member of family, employment shall be provided to the dependent or one family member of the victim by the Department of Personnel.



(iv) For the strengthening of socio-economic condition of the victim f atrocities, the victim shall be covered under the various schemes being implemented by H.P. SC/ST Dev Corporation oon priority basis.



Thus this plan is farfetched, awfully deficient and in deviation from the provisions of Law.

No scheme has been notified under Rule 15 (1) (aa)









III PROSECUTION AND TRIAL


  1. Special amd Exclusive Special Courts.

Section 14 of the Act provides for establishment of Exclusive Special Courts and Special Courts. Its sub section (2) lays down that “it shall be the duty of the State Government to establish adequate number of Courts to ensure that cases under this Act are disposed off within a period of two months, as far as possible.”


District and Sessoins Judges in the State have been designated as Special Courts. No Exclusive Special Courts have been established. Majority of the States in the contry have Exclusive Special Courts. For illustration, Uttar Pradesh has 74 Exclusive Special Courts, Rajsthan has 31-even Punjab has two.


  1. Special Public Prosecutor and Exclusive Special Public Prosecutor.


Section 15 of the Act provides for appointing Special Public Prosecutor and Exclusive Special Public Prosecutors for Special Courts/exclusive Special Courts. Such Public Prosecutor includes any practicing advocate who has been in practice for not less than seven years.


H P State has notified Deputy District Attorneys-cum-Public Prosecutors as Special Public Prosecutors. No other practicing advocate has been designated as such.


Rule 4(1) of PoA Rules requires the State Government to notify a panel of eminent advocates for conducting cases in Exclusive Special Courts and Special Courts. No such list has been notified in HP.

Similarly, Rule 4(1) of PoA Rules empowers and requires DM/SDM to engage engage an eminent senior Advocate for conducting cases in Exclusive Special Courts and Special Courts where necessary and also on the request of victim of atrocity. But this law is also being circumvented.



  1. Bail Matters

Section 18 of the Act provides that “Nothing in section 438 of the Code shall apply in relation to any case involving the arrest of any person on an accusation of having committed an offence under this Act.”

Such provisions notwithstanding, following illustrative cases show how the bails are granted in circumvention of this law:

  1. Opening paragraph of order dated 14.06.2024 of HP High Court, in Cr. MP (M) No. 178 of 2024 a/w in Cr. MP (M) No. 179 of 2024 reads as “persuent to order dated 2.2.2024, whereby this Court after having taken the bail petitioners into custody, enlarged them on bail….(emphasis supplied). [Case FIR No 23/24, dated 31.01.2024, PS Nalagarh u/s 3(1)(r)(s) (za) (d) of PoA].


  1. Second paragraph of order dated 24.05.2024 of HP High Court, in Cr. MP (M) No. 867 of 2024 reads as “the petitioner had surrendered and submitted to the jurisdiction of this Court on 26.04.2024. The petitioner was enlarged on bail on the same date itself.” [Case FIR No 43/24, dated 21.04.2024, PS Janjehli u/s 306/34 IPC & 3(1)(r)(s) of PoA].

  2. Second paragraph of order dated 27.05.2024 of Hp High Coourt, in Cr. MP (M) No. 843 of 2024 reads as “the petitioner had surrendered and submitted to the jurisdiction of this Court on 24.04.2024. The petitioner was enlarged on bail on the same date itself.” [Case FIR No 43/24, dated 21.04.2024, PS Janjehli u/s 306/34 IPC & 3(1)(r)(s) of PoA].


  1. High Court of HP granted interim bail in case FIR No 166/2023 dated 4.1.2023, PS Majra and mentioned in that order that the accused shall apply for regular bail once the charge sheet is filed (mentioned vide order dated 1.4.2024 in Case NO 341/2024, Om Prakash V State of HP by Special Judge Sirmaur at Nahan).



  1. Operative part of third paragraph of order dated 4.4.2024 in Case NO. 57-BA/22 of 2024, Neeraj Bala V State of HP passed by Special Judge Sirmaur at Nahan reads that “since the accused has surrendered before this Court, therefore, she can be released on bail…” Similar orders were made by him in Case NO. 358-BA/22 of 2024, Naresh Kumar V State of HP and Case NO. 59-BA/22 of 2024, Mathura Devi V State of HP, on the same date.



  1. In Himesh Negi Vs State of H.P. which arose out of FIR No. 24/2024 Dated 17.04.2024, PS Anni, Special Judge Kinnaur at Rampur passed the following order:



This application has been filed by the bail applicant for grant of pre-arrest bail. Let notice be issued to the respondent through Ld. P.P. for 24.04.2024. Till then in the event of his arrest in casde of FIR No. 24/2024 dated 17.04.2024 registered under him under sections 323 & 504 I.P.C. and Section 3(1)(r) of SC&ST Act, Police Station, Anni the bail applicant be released on bail…”

  1. In case CIS CNR Nos.HPSO010009472024, CIS Registration No.107/2024, Bail Application No. 38-S/22 of 2024, Joginder Singh Chauhan Vs State of H.P. decided on 22.04.2024, Special Judge Solan passed the following order

  1. In case CIS CNR Nos.HPSO010032802024, CIS Registration No.290/2024, Bail Application No. 118-S/22 of 2024, Virender Kumar Vs. State of H.P. decided on 20.08.2024, Special Judge Solan passed the following order


Petitioner Virender Kumar alias Bita in the present bail application was directed to join investigation by this Court vide order dated 08.08.2024 on his surrender before this Court. He was granted interim bail…”.


  1. In case CIS CNR Nos.HPSO01-001622-2024, HPSO01-001623-2024, HPSO01-001624-2024, CIS Registration No.171/2024, 172/2024 & 173/2024, Bail Application No. 62-S/22 of 2024, Rajinder Singh Vs. State of H.P. decided on 21.05.2024. Special Judge Solan passed the following order


Grant of bail is not opposed by the police or prosecution. However, complainant has opposed grant of bail… Thus, the bail petitions are allowed and interim bail already granted to bail petitioners by this Court vide order dated 04.05.2024 is confirmed”.

[Case FIR No. 35/24 dated 01.05.2024 U/S 341, 504, 506, 234 IPC and 3(1)(r)(s), 3(2)(v)(a) of PoA at PS Arki]


In case Cr.M.P(M) No. 1116 of 2020 along with Cr.M.P.M Nos. 1138-1144, 1184, 1268-1270, 1301, 1333, 1444, 1445, 1563, & 1592 of 2020, Ami Chand Vs. State of H.P., decided on 14.09.2020, the High Court of H.P. has held as follows

67. The interim bail is neither in contradiction to the judicial precedents nor obstructs Justice’s path. Thus, resorting to S. 439 CrPC and surrendering before Sessions Court or High Court and simultaneously obtaining ad-interim bail does not amount to bypassing the restrictions placed in S. 18 and 18-A of SCSTPOA. This practice of the accused surrendering and getting interim bail cannot be said to override the legislative intervention of restraining the anticipatory bail to the violators of the SCSTPOA...”.


However, in case of Cr.M.P.(M) No. 2385 of 2025, Pushpa Devi Vs. State of H.P. decided on 14.10.2025 the High Court of H.P. has held as follows


11. Consequently, the objection taken by Mr Jitender Sharma, learned Additional Advocate General, has to be upheld that the present petition for pre-arrest bail is not maintainable in view of the bar contained in Section 18 of the SC & ST Act. Hence, the present petition is dismissed as not maintainable...”.





III- ANNUAL REPORT

Rule 18 of the PoA rules 1995, vide for submission of Annual Report by the State Government to the Central Government as regards the measures taken for implementation of the provisions of the Act/Rules/Plans. Following is the briefed copy of reports on the implementation of the act as submitted by the Govt of HP to the Central Government in the year 2021, 2022 and 2023.

Legal aid and other facilities provided to persons subjected to atrocities to enable them to avail themselves of Justice

Legal aid & services to SC/STs Women and Children are being provided by the HP State Legal Services Authority. During the calendar year 2021 no legal aid and other facilities have been provoded by the above said authority.

Officers appointed for initiating or exercising Supervision over prosecutions for contravention of the provisions of the Act:

Setting up of SC/ST Protection Cell.

SC/ST Protection Cell has been constituted under Rule 8 of POA Rules, 1995 at State CID Head Quarter, Shimla, under the supervision of Director General of Police Shimla-2.

Constitution and frequency of conduct of meetings of State, District and Sub-Divisional Vigilance Level Monitoring Committees and review implementation of victims and witnesses in accessing justice as specified in sub-section (ii) of section 15A of Chapter IVA of the Act, relief and rehabilitation of atrocity victims, prosecution of cases and review of various reports received by the State Governments/UT Administration.

For the effective implementation of the SCs/STs(PoA)Act, 1989 and Rule 1995, thefollowing committees at State/District Level have of been constituted: -


(1) State level Vigilance & Monitoring Committee under the Chairmanship of Hon'ble Chief Minister has been constituted and the last review meeting convened at State level on 16-10-2014.


(2) District Level Vigilance & monitoring Committees under the Chairmanship of respective District Magistrates have been set up at the district levels. The details of meeting convened during the year are enclosed at Annexure-IX.

(3) Sub-Divisional Level Vigilance & Monitoring Committees have been constituted in seven districts i.e. Chamba, Hamirpur, Kangra, Kinnaur, Kullu, Shimla and Sirmour. The details of Committees and meeting convened during the year are enclosed at Annexure-IX Sr.No-C.
